Your Privacy Rights

LifeYield, LLC and its subsidiary companies (referred to herein as “LifeYield”, “Company”, “we”, “us” and “our”) respect the privacy rights of our online visitors, subscribers and end users (referred to herein as “Subscriber”, “User”, “you” or “your”) and recognize the importance of protecting the information collected from you. We have adopted this corporate wide Privacy Policy (the “Policy”) that describes 1) the types of information gathered by LifeYield in the process of providing our proprietary software solutions LifeYield Proposal Advantage® , LifeYield Advantage Suite® , LifeYield Portfolio Advantage® , LifeYield Income Advantage® and/or LifeYield Social Security Advantage® , including the output therefrom, any companion computing applications and data, website information, tools, updates and similar materials delivered or provided by us (collectively, the “LifeYield System”); 2) how we use it, 3) with whom the information may be shared, 4) what choices are available to you regarding collection, use and distribution of the information and 5) our efforts to protect the information you provide to us through the LifeYield System. By using the LifeYield System, you hereby consent to allow us to process information in accordance with this Policy. Please also refer to the LifeYield System Terms of Use (the “TOU”), which are incorporated as if fully recited herein. Capitalized terms used herein without definitions in this Policy shall have the definitions ascribed to them in the TOU.

Please note that this Policy applies only to sites maintained by the Company and the LifeYield System. For clarity, this Policy does not apply to websites maintained by other companies or organizations to which we link or any other third party service providers. Further, this Policy applies only to you as an individual person using the LifeYield System, and does not apply to the companies or organizations at which you may be employed or that you may otherwise represent.

Territoriality
Regardless of where our servers are located, any personal data you enter may be processed by us in the United States, where data protection and privacy regulations may or may not be to the same level of protection as in other parts of the world. BY VISITING THE LIFEYIELD WEBSITE AND USING THE LIFEYIELD SYSTEM, YOU UNEQUIVOCALLY AND UNAMBIGUOUSLY CONSENT TO THE COLLECTION AND PROCESSING IN THE UNITED STATES OF ANY INFORMATION COLLECTED OR OBTAINED BY US THROUGH VOLUNTARY SUBMISSIONS, AND THAT U.S. LAW GOVERNS ANY SUCH COLLECTION AND PROCESSING.

Information Collection and Use
Our primary goal in collecting personally identifiable information is to provide you with the products and services made available through the LifeYield System and/or the LifeYield Website (the “Website”) to communicate with you and to manage your registered user account, if you have one.

Information Collected Upon Registration
When using the LifeYield System, you will be required to become a registered user, and to submit certain personally identifiable information to LifeYield. This happens in a number of instances, such as when you sign up to use the LifeYield System, or if you desire to receive marketing materials and information. Personally identifiable information that we may collect in such instances may include your full name, age, gender, username, password, email address, address, telephone number, credit card number, information about your income and other information that you decide to provide us with, or that you decide to include in your public profile including your responses to question prompts provided by the LifeYield System (collectively, “Personal Information”).

Information Collected During Use of the LifeYield System
Upon access to and use of the LifeYield System, you may submit certain information, sometimes including personally identifiable information, about you and/or your clients. Personally identifiable information that we may collect in such instances may include, but is not limited to, your client’s full name, age, gender, and/or investment portfolio information and investment goals (collectively, “Client Personal Information”).

Log Data
When you use the LifeYield System, our servers automatically record information that your browser sends whenever you visit a website as Log Data. This Log Data may include information such as your IP address, browser type or the domain from which you are visiting, the websites you visit, the search terms you use, and any advertisements on which you click. For most users accessing the Internet from an Internet service provider, the IP address will be different every time you log on. We use Log Data to monitor the use and technical administration of the Website and of the LifeYield System. We do not associate your IP address with any other personally identifiable information to identify you personally, except in case of violation of the TOU.

Cookies
We use cookies and other technologies to passively collect demographic information, personalize your experience on our Website and the LifeYield System as well as monitor advertisements and other activities. Cookies are small files downloaded to your computer to track movements within web sites. We may link cookie information to personal information. Cookies link to information regarding what items you have selected for purchase from our Website or pages you have viewed. This information is used to keep track of your shopping cart and make sure you don’t see the same ad repeatedly. Also, we use cookies to deliver content specific to your interest and to monitor usage or our Website and/or the LifeYield System. Some of our sites use an outside ad company to display ads. These ads may contain cookies. Our ad companies collect cookies received with banner ads, and the Company does not have access to this information. Most browsers are automatically set to accept cookies whenever you visit a website. You can disable cookies or set your browser to alert you when cookies are being sent. However, some areas of our sites will not function properly if you do so. Please note that this Policy covers the use of cookies by the Company only and does not cover the use of cookies by any advertisers or any third-party service providers.

Applicable Law
LifeYield maintains compliance with applicable Federal and state laws regarding the use non-public personal information.

Law Enforcement
We cooperate with government and law enforcement officials or private parties to enforce and comply with the law. We may disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims, legal process (including subpoenas), to protect the property and rights of the Company or a third party, the safety of the public or any person, to prevent or stop any illegal, unethical, or legally actionable activity, or to comply with the law.

Data Retention
LifeYield does not retain any non-public private information for any longer than is necessary to fulfill its current and ongoing obligations as described by its terms of us and or service agreements.

Data Destruction
When it is no longer contractually obligated or permitted to retain non-public private information, LifeYield disposes of such data in a manner meant to prevent loss, theft, misuse, or unauthorized access to such information and in secure manner consistent with the type of media on which the data is stored.

Business Transfers
We may sell, transfer or otherwise share some or all of our assets, including Personal Information and Client Personal Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy. You will have the opportunity to opt out of any such transfer if the new entity’s planned processing of your information differs materially from that set forth in this Policy.

The LifeYield System as well as our Website may contain links to other websites. We are not responsible for the privacy practices of such other sites. When you leave our Website and/or the LifeYield System platforms to visit another website or application, please read the privacy statements of such websites and/or services platforms that may collect personally identifiable information.

Security
We employ procedural and technical safeguards to secure your personal information against loss, theft, alteration, and unauthorized access, use and disclosure. We also employ security procedures to protect your information from unauthorized access by users inside and outside the Company.

Regardless of the precautions we take, no transmission of data over the Internet is guaranteed to be completely secure. It may be possible for third parties not under our control to intercept or access transmissions or private communications unlawfully. While we strive to protect personal information, we cannot ensure or warrant the security of any information you transmit to us.

E-Mail and Electronic Newsletters
We may offer electronic newsletters and e-mails concerning promotions, new products and services, or other marketing materials as a service to our users. You may receive newsletters and e-mails concerning promotions and marketing of ours, after you register with the LifeYield System or Website. If, after you have received a message, you no longer wish to receive such materials, you may opt-out by following the unsubscribe instructions included in each electronic newsletter and e-mail.

Access and Control
Some of the information collected about you may be retrievable and changeable through your account. To do so, follow instructions on the LifeYield System.

Communication Tools
The LifeYield System and our Website may contain tools that enable you to share Personal Information and/or Client Personal Information with others. Should you choose to use such tools, please exercise caution when sharing sensitive information.

Do Not Track
At this time, the LifeYield System does not specifically respond to do-not-track signals.

Children and Privacy
We do not knowingly permit users to register for use of the LifeYield System or our Website if they are under 18 years old, and therefore do not request personally identifiable information from anyone under the age of 18. If we become aware that a User is under the age of 18 and has registered without prior verifiable parental consent, we will remove his or her personally identifiable registration information from our files. If you are the parent or guardian of a person under the age of 18 who has provided personally identifiable information to us without your approval, please inform us by contacting us at the e-mail address below and we will remove such information from our database.

California Privacy Rights
California law allows California residents to request information regarding our disclosures in the prior calendar year, if any, of their personally identifiable information to third parties. To make such a request, please contact us at info@lifeyield.com with “Request for Privacy Information” in the subject line. Please include enough detail for us to locate your file; at a minimum, your name, email, and username, if any. We will attempt to provide you with the requested information within thirty (30) days of receipt. We reserve our right not to respond to requests sent more than once in a calendar year, or requests submitted to an address other than the one posted in this notice. Please note that this law does not cover all information sharing. Our disclosure only includes information covered by the law.
